SE XUA L HARASSMENT ( PROTECTION AND PREVENTION) T H E UN I V E R S I T Y OF TE CHNO L OGY , J AMA I CA – ST UD E NT HANDBOOK 2025– 2026 Any breach of this Ordinance shall result in an investigation, the result of which may lead to disciplinary action in accordance with Ordina- nce 1999/15 - Staff Redundancy, Discipline, Dismissal, Removal and Grievance Procedure or Ordinance 1999/14 – Student Discipline. the action that will be taken where the report is found to have been falsely made or otherwise untrue. iv. 11 . 2.9 The University shall not conduct an enquiry or shall discontinue an investigation where the complainant has submitted a written request to not pursue the matter, or the University has reasonable grounds to conclude that the report is vexatious, misconceived or lacking in substance. 12.0 REGI STER 12 . 1 The University shall maintain or cause to be maintained, a register containing the following information in respect of every sexual harassment claim lodged pursuant to section 5 or 6 of the Sexual Harassment Act: i. the name of the parties to the sexual harassment claim; ii. the particulars of the sexual harassment claim; iii. the date of which the sexual harassme- nt claim was lodged; iv. any action taken by the university in relation to the sexual harassment claim; v. such other particulars relating to the sexual harassment claim as may be deemed necessary. 12 . 2 Even in instances where the matter is resolved informally, the complaint made must be committed to writing and placed on the file of the person against whom the complaint is being made. The notation on the file is not with respect to the veracity of the complaint but only to the fact that a complaint was made. 13.0 SANCTIONS 13. 1 Where a sexual harassment complaint has been referred to a formal hearing in aacord- ance with section 11, the resulting decision may be appealed through the University’s established grievance and discipline proced- ures for the various categories of staff and students. 14 .0 APPEALS 14 . 1 Internal appeal 14 . 1.1 15 .0 COMPLAINTS TO TRIBUNAL The Complainant is encouraged to exhaust all internal mechanisms and procedures that are available to the complainant before making a complaint before the tribunal. 15. 1 Notwithstanding the provisions of section 15.1.1, where an allegation of sexual harassm- ent is made against an employer or a person who is in charge of the university, the emplo- yee or student may make a complaint directly to the Tribunal. 15. 2 If a mutually agreed upon resolution is not achieved or if the Designated Officer deems it necessary, the report shall be referred to the Sexual Harassment Tribunal which has 15 . 3 271
