SE XUA L HARASSMENT ( PROTECTION AND PREVENTION) 15 . 4 Notwithstanding section 15.1.1, the tribunal may grant leave to a student or employee to make a complaint to the tribunal in the circumstances where the tribunal is satisfied that the complainant has: i. Shown cause as to why the person reasonably believes that the person’s right may be prejudiced if the person were to comply with section 15.1.1. ii. Provided evidence to show that no internal mechanisms or procedure or no adequate internal mechanisms and procedures have been made available to the complainant in line with the Sexual Harassment Act. 16 . 4 UTech, Ja shall not disclose any information relating to a complainant, or the circumst- ances of a complaint to any person, except where the disclosure is necessary for the purposes of investigating the complaint or taking disciplinary action in relation to the complaint. Any breach will be viewed as an act of misconduct and will be subject to disciplinary action, pursuant to the University’s disciplinary code. 17 .0 PROFESSIONAL SUPPORT The University will arrange and pay for professional counselling, of up to four (4) sessions, for an individual who is found to have been sexually harassed or who was wrongfully accused of sexual harassment. This support may also be extended to someone who is found guilty of sexual harassment, where the particular circumstances so warrant. 17. 1 Existing employees shall be sensitized about this Ordinance using any method. The Ordi- inance shall also be included as part of the University’s orientation programme for new workers. Students will be sensitized about this Ordin- ance via their student’s handbook and also and during their orientation sessions at the beginning of the academic year. 18 . 1 oversight for sexual harassment matters. The Tribunal shall take all reasonable steps necessary to evaluate the claim of sexual harassment and make a determination of liability or lack thereof of the accused harasser(s). 16 .0 CONFIDENTIALITY OF 18 .0 TRAINING AND SENSITIZATION 18 . 2 REPORT 16 . 1 The original recipient of the report of sexual harassment and all other persons with whom information concerning the matter is shared, are expected to treat with this carefully. 16 . 2 All claims of sexual harassment shall be documented and placed on a confidential file, thoroughly archived for the purposes of monitoring and evaluation. 16. 3 UTech, Ja will endeavor to protect the privacy of all parties involved throughout the course of the investigation.
